SBB Photography Terms & Conditions

Under current copyright laws, ownership of all images belongs entirely to Sarah Baker (“Photographer”), owner of SBB Photography LLC. The Photographer retains full copyright and all rights to all images created unless otherwise agreed upon in writing.

The Photographer grants the Listing Agent (“Client”) a limited, non-exclusive, non-transferable license to use the delivered images solely for marketing and promotional purposes related to the specific property photographed.

All images produced for the Client may be used by the Client for marketing materials and campaigns directly associated with the property, as well as for the Client’s self-promotion, until the license expires. The Client’s brokerage or parent company may also use the images only for the purpose of marketing the specific property photographed.

Any use of the images by a third party—including but not limited to architects, builders, stagers, designers, sellers, or buyers—is strictly prohibited without prior written consent from the Photographer. Unauthorized use beyond the licensed term or for unrelated purposes may result in additional licensing fees or legal action.

The Photographer is an independent contractor, and shall not be deemed to be an employee of the Client. No agency, partnership, joint venture, or employee-employer relationship is intended or created by this agreement. Neither party is authorized to act as agent or bind the other party except as expressly stated in this agreement. The Photographer and the photos or any other deliverables prepared by the Photographer shall not be deemed a work for hire as defined under Copyright Law. All rights granted to Client are contractual in nature and are expressly defined by this agreement.

It is the Client and/or home owner’s responsibility to have the home in photo ready condition prior to the photographer arriving. The photographer may make minor adjustments to improve the shot, but they cannot move furniture or make significant changes, clean the home, etc. If the photographer cannot adequately shoot the property once they arrive due to reasons beyond our control (such as, but not limited to a) unable to gain access to the property b) excessive clutter and mess c) unrestrained animals) you will be reimbursed minus a $75 cancellation fee. If the Client is not present, the photographer has the authority to photograph the property “as is” and will not take responsibility for clutter or unwanted items in the picture.

In the case that the Photographer feels unsafe or threatened in any way while on site, the Photographer has the right to leave the scene immediately regardless of progress. An on spot cancellation fee of $75 may apply to the client's account and the Photographer reserves the right to deny rescheduling.

If, for any reason, you are unable to keep your scheduled appointment please give 12 hours notice so we can reschedule you at a more appropriate time and open your time slot to others. Cancellations with less than 12 hours notice may incur a $75 cancellation fee. Appointments rescheduled within 2 hours of the scheduled appointment time may incur a $25 rescheduling fee.

Please make any special requests known to the photographer before the shoot begins, including specific shots, angles, etc. Otherwise the photographer will shoot the home based on experience, the home’s condition, lighting, and other factors to get the best possible shots. 

Turnaround time is between 24–48 hours. Although you may get your photos back in less time we cannot guarantee it. If you have a situation that requires a quicker turn around time please inquire about options for express service at an additional fee.

All payments are due prior to gallery release. If payment is not received within 24 hours of the final edits, the credit card on file will be automatically charged. A $30 chargeback fee will be applied to your invoice for any declined transactions. Checks and PayPal payments are available upon request. Please email or text me before booking to arrange this payment method.

We service the greater Richmond area and will travel within 30 miles of the city center without any additional fees. Beyond 30 miles, a travel fee of $1 per mile will be added to your total. Additional fees may be imposed during high traffic times such as rush hour or holidays.

In order to make our appointments more efficient, we will often reuse photographs of communities, neighborhoods, common areas, shared property attributes and facilities including, but not limited to, gyms, pools, lobbies, exteriors, etc. beforehand, afterward, or from previous photography sessions. This helps us deliver consistent, timely, and quality photos and marketing materials for our clients. We provide these photos at no extra cost, except when the photos necessitated an additional charge at the time at which they were taken (e.g. aerial photos). Unless a specific photo shoot for these areas or neighborhoods was ordered with an exclusive license, the Photographer is free to use the photos across our platforms and for additional listings.

This Agreement does not create an exclusive relationship between the parties. The Photographer is free to engage others to perform services of the same or similar nature to those provided by the Photographer, solicit other clients, and otherwise advertise all offered services.

Residential Listings:

The license is valid for one calendar year from the date the images are delivered, or until the property is sold, whichever comes first.

Rental & Extended Listings:

For rental properties, vacation homes, or long-term marketing campaigns, the license is valid for three years from the date of delivery.

Commercial Properties:

Licensing duration and terms for commercial projects will be outlined separately in the project agreement.
